服務條款

1. 條款接受

下載、安裝或使用 TonesFly（「本應用程式」）即表示您同意受這些服務條款（「條款」）的約束。本應用程式由 Thang Pham（「TonesFly」、「我們」或「我方」）營運。如果您不同意這些條款，請勿使用本應用程式。

2. 服務說明

TonesFly is a language learning application that helps users improve language listening comprehension through interactive audio practice. Users import their own audio content, which is processed on-device into structured listening challenges. The App is available for free.

3. 帳戶

您可以在不建立完整帳戶的情況下以訪客模式瀏覽 TonesFly 的某些部分。若要匯入音訊、處理課程、恢復購買或跨裝置同步進度，您必須透過 Apple Sign-In、Google Sign-In 或電子郵件建立或連結帳戶。您有責任維護帳戶憑證的機密性，並對帳戶下的所有活動負責。

4. 使用者上傳內容

You retain ownership of audio files you import into the App. By importing content, you grant the Licensor a limited, non-exclusive license to process such content solely for the purpose of generating listening practice challenges for your personal use.

All processing happens entirely on your device. Audio files, transcripts, and lesson data never leave your device (except for optional iCloud sync). Practice data is stored locally on your device.

You are solely responsible for ensuring you have the necessary rights to use any audio content within the App.

All features are available for free. Users can import audio and create lessons on-device — audio never leaves your device. All processing happens entirely on your device; no audio, transcripts, or lesson data are sent to any server.

7. 智慧財產權

All content in TonesFly — including but not limited to the user interface, design, graphics, audio processing algorithms, and software code — is owned by Thang Pham, operating as TonesFly, or its licensors, and is protected by copyright and other applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the App without our express written permission.

我們使用基於同意的分析工具（PostHog）來改進本應用程式。當您從行銷連結開啟 TonesFly 時，可能會收集匿名的活動參數（例如 UTM 來源、媒介、活動名稱）以衡量行銷效果。這些參數不包含個人身份資訊。包括活動歸因在內的所有分析資料均受您的隱私權同意設定約束，且不會從未成年使用者處收集。詳情請參閱我們的隱私權政策。

如果您違反這些條款，我們保留自行決定暫停或終止您帳戶的權利。我們終止帳戶後，您使用本應用程式的權利立即失效，上傳的內容可能會被刪除。

您可以隨時在「設定」>「刪除帳戶」中請求刪除帳戶。刪除請求將進入7天寬限期，在此期間您可以透過登入來取消。寬限期過後，您的帳戶和相關資料將被永久刪除。我們會在刪除計畫確定時傳送確認郵件，在刪除前24小時傳送提醒，並在刪除後傳送確認。

TonesFly 無法刪除儲存在您 iCloud 帳戶中的資料；iCloud 資料由 Apple 管理。

第7、12和13條在終止後繼續有效。

本應用程式按「現狀」和「可用」基礎提供，不附帶任何明示或暗示的保證。我們不保證從上傳音訊產生的語音辨識、轉錄或練習的準確性。處理結果可能因音訊品質、語言和內容而異。

12. 責任限制

在適用法律允許的最大範圍內，以 TonesFly 名義營運的 Thang Pham 不對因您使用或無法使用本應用程式而產生的任何間接、附帶、特殊、後果性或懲罰性損害，或任何利潤或資料損失承擔責任。我們對任何索賠的總責任不超過您在索賠前12個月內向我們支付的金額。

此限制不適用於根據適用法律（包括歐盟消費者權利指令、英國2015年消費者權利法或同等的當地消費者保護立法）不能排除或限制的責任。

13. 準據法

本條款受越南社會主義共和國法律管轄並按其解釋。因本條款引起的任何爭議應在越南慶和省有管轄權的法院解決。

如果您是歐盟、英國或任何具有強制性消費者保護法的司法管轄區的消費者，本條款中的任何內容均不剝奪您所在居住國強制性法律對您的保護，您可以在當地法院提起訴訟。

14. 著作權侵權 (DMCA)

我們尊重智慧財產權。如果您認為我們服務上的內容侵犯了您的著作權，請向 [email protected] 傳送書面通知，包含以下資訊：

收到有效通知後，我們將及時移除或禁止存取涉嫌侵權的內容，並通知上傳該內容的使用者。屢次侵權者的帳戶可能會被終止。

15. 條款變更

我們可能隨時修改這些條款。我們將透過本應用程式或電子郵件通知您重大變更。變更後繼續使用本應用程式即表示接受更新後的條款。

16. Apple 相關條款

本協議僅在您與 TonesFly 之間達成，不與 Apple Inc.（「Apple」）之間達成。TonesFly（而非 Apple）對本應用程式及其內容承擔全部責任。Apple 沒有義務提供維護或支援。Apple 及其子公司是本條款的第三方受益人。
