1. 条款接受

下载、安装或使用 TonesFly（"本应用"）即表示您同意受这些服务条款（"条款"）的约束。本应用由 Thang Pham（"TonesFly"、"我们"或"我方"）运营。如果您不同意这些条款，请勿使用本应用。

2. 服务说明

TonesFly is a language learning application that helps users improve language listening comprehension through interactive audio practice. Users import their own audio content, which is processed on-device into structured listening challenges. The App is available for free.

3. 账户

您可以在不创建完整账户的情况下以访客模式浏览 TonesFly 的某些部分。要导入音频、处理课程、恢复购买或跨设备同步进度，您必须通过 Apple Sign-In、Google Sign-In 或电子邮件创建或关联账户。您有责任维护账户凭据的机密性，并对账户下的所有活动负责。

4. 用户上传内容

You retain ownership of audio files you import into the App. By importing content, you grant the Licensor a limited, non-exclusive license to process such content solely for the purpose of generating listening practice challenges for your personal use.

All processing happens entirely on your device. Audio files, transcripts, and lesson data never leave your device (except for optional iCloud sync). Practice data is stored locally on your device.

You are solely responsible for ensuring you have the necessary rights to use any audio content within the App.

All features are available for free. Users can import audio and create lessons on-device — audio never leaves your device. All processing happens entirely on your device; no audio, transcripts, or lesson data are sent to any server.

All content in TonesFly — including but not limited to the user interface, design, graphics, audio processing algorithms, and software code — is owned by Thang Pham, operating as TonesFly, or its licensors, and is protected by copyright and other applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the App without our express written permission.

如果您违反这些条款，我们保留自行决定暂停或终止您账户的权利。我们终止账户后，您使用本应用的权利立即失效，上传的内容可能会被删除。

您可以随时在"设置">"删除账户"中请求删除账户。删除请求将进入7天宽限期，在此期间您可以通过登录来取消。宽限期过后，您的账户和相关数据将被永久删除。我们会在删除计划确定时发送确认邮件，在删除前24小时发送提醒，并在删除后发送确认。

TonesFly 无法删除存储在您 iCloud 账户中的数据；iCloud 数据由 Apple 管理。

第7、12和13条在终止后继续有效。

本应用按"现状"和"可用"基础提供，不附带任何明示或暗示的保证。我们不保证从上传音频生成的语音识别、转录或练习的准确性。处理结果可能因音频质量、语言和内容而异。

12. 责任限制

在适用法律允许的最大范围内，以 TonesFly 名义运营的 Thang Pham 不对因您使用或无法使用本应用而产生的任何间接、附带、特殊、后果性或惩罚性损害，或任何利润或数据损失承担责任。我们对任何索赔的总责任不超过您在索赔前12个月内向我们支付的金额。

此限制不适用于根据适用法律（包括欧盟消费者权利指令、英国2015年消费者权利法或同等的当地消费者保护立法）不能排除或限制的责任。

13. 适用法律

本条款受越南社会主义共和国法律管辖并按其解释。因本条款引起的任何争议应在越南庆和省有管辖权的法院解决。

如果您是欧盟、英国或任何具有强制性消费者保护法的司法管辖区的消费者，本条款中的任何内容均不剥夺您所在居住国强制性法律对您的保护，您可以在当地法院提起诉讼。

14. 版权侵权 (DMCA)

我们尊重知识产权。如果您认为我们服务上的内容侵犯了您的版权，请向 [email protected] 发送书面通知，包含以下信息：

收到有效通知后，我们将及时删除或禁止访问涉嫌侵权的内容，并通知上传该内容的用户。屡次侵权者的账户可能会被终止。

15. 条款变更

我们可能随时修改这些条款。我们将通过本应用或电子邮件通知您重大变更。变更后继续使用本应用即表示接受更新后的条款。

16. Apple 相关条款

本协议仅在您与 TonesFly 之间达成，不与 Apple Inc.（"Apple"）之间达成。TonesFly（而非 Apple）对本应用及其内容承担全部责任。Apple 没有义务提供维护或支持。Apple 及其子公司是本条款的第三方受益人。
